Chasing an unpaid invoice: 3 email templates and a letter
8 min read·Updated on 15 September 2026
Definition
An unpaid invoice reminder is how a business asks its customer to pay an invoice that has reached its due date. It starts with a written or phone reminder and can go as far as a formal notice, the last amicable step before debt recovery proceedings.
Formal notice letter in Word and PDF, to send by registered mail with acknowledgement of receipt.
Late payment penalties are due without reminder from the day after the due date: 12.40% in the second half of 2026 if no rate was agreed.
Fixed recovery fee: €40 per invoice paid late, for a business customer.
Suggested schedule: D+1, D+15, then formal notice around D+30. A practice, not an obligation.

Chasing an unpaid invoice: the suggested schedule
No French rule sets a reminder schedule: service-public.fr even points out that a reminder is not a prerequisite for a formal notice. The schedule below is a common practice, to adapt to your customers.
Between businesses, the law is on your side: late payment penalties are due from the day after the due date, without reminder, and a €40 fixed fee is added for each invoice paid late.
1
Reminder before the due date
a few days before
A short message to check the invoice was received and approved. Disagreements come up before the delay.
2
Friendly reminder
D+1
Payment may have crossed with your message. Courteous tone, invoice attached, payment method restated.
3
Firm reminder and call
D+15
Reminder of the penalties and the €40 fee, call to the accounts department to get a payment date.
4
Formal notice
D+30
Registered letter with acknowledgement of receipt, precise payment deadline, proceedings announced.
5
Debt recovery
after the deadline
Simplified procedure by a commissaire de justice up to €5,000, or an application for an order for payment.
IIEmail templates
3 reminder email templates to copy
Replace the placeholders in brackets. Attach the invoice every time and write to the department that pays, often accounts payable, as well as your usual contact.
Template 1: friendly reminder
on the due date or D+1
Subject: Invoice [number] of [date]: due on [date]
Hello [first name],
Unless we are mistaken, invoice no. [number] for [amount] € including VAT, due on [date], does not yet appear in our receipts. You will find it attached.
If payment crossed with this message, please disregard it. Otherwise, could you tell us the expected payment date?
As a reminder, payment is made by transfer to IBAN [IBAN], quoting the invoice number.
Kind regards, [First Last], [Your company]
Template 2: firm reminder
D+15
Subject: Reminder: invoice [number] unpaid since [date]
Hello [first name],
Despite our message of [date], invoice no. [number] for [amount] € including VAT, overdue since [date], remains unpaid.
Please settle it within eight days. Under our general terms of sale, late payment incurs penalties at [rate] % a year from the day after the due date, and a fixed recovery fee of €40.
If something is blocking the payment (purchase order, delivery, amount), let us know and we will sort it out quickly.
Regards, [First Last], [position], [Your company]
Template 3: formal notice
around D+30, with the registered letter
Subject: Formal notice to pay: invoice [number]
Dear Sir or Madam,
As our reminders of [date] and [date] went unanswered, we are today sending you, by registered letter with acknowledgement of receipt, a formal notice to pay the sum of [amount] €, a copy of which is attached.
Failing payment of this sum, plus late payment penalties and the €40 fixed fee per invoice, within [eight] days of receipt of the letter, we will start debt recovery proceedings.
Late payment penalties and the €40 fee: what the law says
Between businesses, late payment has a price set by the French commercial code (articles L441-10 and D441-5), detailed by service-public.fr in its page on payment terms, checked on 7 August 2026.
Rule
Second half of 2026
Rate if none agreed
ECB refinancing rate on 1 January or 1 July, plus 10 points
2.40% + 10 points = 12.40%
Minimum agreed rate
3 times the legal interest rate
3 × 2.75% = 8.25%
Starting point
The day after the payment date shown on the invoice
No reminder or formal notice needed
Fixed fee
€40 per invoice paid late, once
Higher costs on proof
As an illustration, pro rata to the days late: an invoice of €2,400 due on 30 September 2026 and paid on 30 October, 30 days later, bears penalties at 12.40% of 2,400 × 12.40% × 30 / 365 = €24.46, plus the €40 fee.
With a consumer customer, the €40 fixed fee does not apply: service-public.fr reserves it for business customers.
IVFormal notice
Formal notice, then recovery: the next steps
A formal notice demands payment formally. Service-public.fr cites three forms: a summons by a commissaire de justice, a registered letter with acknowledgement of receipt containing a sufficient demand, or a clause in the contract. No deadline is imposed: set a precise one, for example eight days, and keep the acknowledgement of receipt.
If it has no effect, two routes exist:
the simplified procedure for small claims, by a commissaire de justice, up to €5,000: if the debtor agrees within a month, an enforceable title is issued;
an order for payment: between traders, an application to the commercial court (or economic activities court), no lawyer required, €33.47 in court fees; the debtor has one month to object after service.
💡
Golden rule
Record every reminder, call and promise of payment with its date: this file supports the formal notice, then the application.
VFrequently asked questions
Answers to the questions we get asked most.
Do I have to send a reminder before a formal notice?
No, a reminder is not a prerequisite, according to service-public.fr. It still often solves a simple oversight without harming the relationship.
Are late payment penalties due without a reminder?
Yes, between businesses, from the day after the due date: 12.40% in the second half of 2026 with no agreed rate, never less than 8.25% with an agreed rate.
Does the €40 fee apply to every invoice?
Yes, once per invoice paid late, for a business customer. Higher recovery costs can be claimed on proof.
Is a formal notice sent by email enough?
Service-public.fr cites a summons by a commissaire de justice, a registered letter with acknowledgement of receipt and a contract clause, not email. So send the letter by registered mail with acknowledgement of receipt and back it up with an email, as template 3 suggests.
What if the customer disputes the invoice?
Pause reminders on that amount and deal with the disagreement: ask in writing what is disputed (quantity, delivery, price), correct it if needed with a corrective invoice or a credit note, then resume reminders on the undisputed sum.
